Gramm-Leach-Bliley Act

Requires financial institutions to take proactive measures to protect personal financial information of customers and consumers. HIPAA - Health Insurance Portability and Accountability Act

FACTA is a new Federal Law designed to reduce the risk to consumers of fraud and identity theft, created by improper disposal of financial information. The Law states that “any person who maintains or otherwise possesses consumer information for a business purpose” must destroy all consumer information properly when disposing of the material. There are provisions in the law that allow for substantial damages, both actual and statutory damages, plus Federal and State punitive penalties for failure to comply. A successful plaintiff may recover reasonable attorney fees. A Class Action Suit could easily total over 1,000,000.
